General Terms and Conditions of Sale
Article No. 1: Purpose
The general terms and conditions of sale set out below detail the rights and obligations of the company Perla and its customer in the context of the sale of the following goods: Necklace, bracelet, and earrings made of freshwater pearl and other precious and semi-precious stones.Any service performed by the company Perla therefore implies the buyer's unreserved acceptance of these general terms and conditions of sale.
Article No. 2: Price
Perla reserves the right to change its prices at any time. However, it commits to manufacturing the goods ordered at the prices indicated when the order was placed.
Article No. 3: Discounts and rebates
The prices offered include any discounts and rebates that Perla may grant based on its performance or the buyer's assumption of certain services.Article No. 4: Discount
Clause No. 5: Payment Terms
Orders are paid for as follows:
- either by bank card
- either by bank transfer
- either with Alma or KLARNA
Clause No. 6: Late Payment
In the event of total or partial non-payment for goods delivered on the day of receipt, the buyer must reimburse Perla a late payment penalty equal to three times the legal interest rate.The applicable legal interest rate is that in effect on the day the goods are delivered.
From 1 January 2015, the legal interest rate will be revised every 6 months (Ordinance No. 2014-947 of 20 August 2014) .
This penalty is calculated on the total amount including tax of the sum remaining due, and runs from the date of payment without any prior formal notice being required.
Articles 441-6, I paragraph 12 and D. 441-5 of the commercial code.
Clause No. 7: Termination Clause
If, within fifteen days of the implementation of the "Late Payment" clause, the buyer has not paid the remaining sums due, the sale will be automatically terminated and may give rise to a right to compensation for damages in favor of the company Perla.Clause No. 8: Retention of Title Clause
Perla retains ownership of the goods sold until full payment of the price, including principal and any additional charges. Therefore, if the buyer becomes subject to receivership or liquidation proceedings, the company ... (company name) reserves the right to reclaim, within the framework of the insolvency proceedings, the unpaid goods sold and held in its possession.Clause No. 9: Delivery
The delivery has been made:
Once the package is handed over to the delivery service, the latter undertakes to deliver the goods within 7 days of shipment. If the package is not received by the date indicated by the seller or within this 7-day period, the customer whose package is lost may request cancellation of the contract ( Article L. 216-2 of the French Consumer Code): the seller is then obligated to resend the products, issue a credit note, or provide a refund within 7 daysof the request.

either by postal parcel within: Mondial Relay 3 to 6 working days (excluding weekends and public holidays)
- Colissimo France 2 to 4 working days (excluding weekends and public holidays)
- Colissimo Europe: 5 to 10 working days (excluding weekends and public holidays)
- Delivery outside Europe: 5 to 10 working days (excluding weekends and public holidays)
- Colissimo Algeria 5 to 20 working days (excluding weekends and public holidays).
- either at the location indicated by the buyer on the order form
- the allocation of damages and interest
- order cancellation.
In the event of missing or damaged goods during transport, the buyer must make all necessary reservations on the delivery note upon receipt of the goods in question. These reservations must also be confirmed in writing within five days of delivery by registered mail with return receipt requested.
Clause No. 10: Force Majeure
Perla shall not be held liable for any failure to perform or delay in performing any of its obligations under these terms and conditions of sale if such failure or delay is due to force majeure. For the purposes of this clause, force majeure shall mean any external, unforeseeable, and irresistible event as defined in Article 1148 of the French Civil Code.Article 11: Jurisdiction
Any dispute relating to the interpretation and execution of these general terms and conditions of sale shall be subject to French law.Clause No. 12: Cancellation, Return and Refund
Regardless of this right of withdrawal, if a non-personalized Product does not meet the customer's expectations, the customer benefits from the "satisfied or refunded" guarantee of 21 days from the date of receipt of the product for return to the seller for an exchange or a refund.
The right of withdrawal and the "Satisfied or Refunded" guarantee do not apply to items personalized at the request of the Customer and Gift Cards. Gift cards are non-refundable.
To receive a refund as quickly as possible, the customer must return the items to the seller. The return shipping costs remain the responsibility of the customer.

After the Seller has responded favorably to the customer's request (refund or exchange), the customer must proceed to return the goods, taking care to return the goods in their original condition and repackaged with quality packaging.
Since the costs and risks of transport are borne by the customer, we advise you to return your item preferably by registered mail.
In case of loss of the package, no refund will be issued without proof of posting.
The seller informs the Customer that he does not accept packages sent with postage due.
Only items returned in new condition and without having undergone any alteration will be exchanged or refunded.
Items that have been worn, are incomplete, damaged, or soiled will not be accepted for return.
The refund or exchange will be made after receipt of the product by the Seller and verification of its condition, within 14 days.
The refund will be made by bank transfer or by check.
It is necessary to provide all the information required for the refund, in particular the email address and order number.
If the seller cannot locate the sender of the package, the package will be set aside pending information from the customer. After a waiting period of one month, the seller will not be able to issue a refund, but only a credit note for the amount of the returned items.
"For hygiene reasons, earrings can only be returned if they are in their original packaging, with the tag attached, and have not been worn. No returns or exchanges will be accepted if the packaging has been opened."

Our jewelry is guaranteed for 1 year upon presentation of your invoice.
Shipping costs are your responsibility.
The repair time is approximately 1 month.
Each creation is handmade in our workshop in Grenoble, France, by the designer.
It may have slight imperfections or irregularities due to its handcrafted nature. This piece of jewelry is made of gold, 925 sterling silver, or gold plating. Your jewelry will be delivered in a gift box.
